名人隐私报道中的法律问题与伦理问题

Legal and Ethics Questions in Media's Report of Celebrity Privacy

本文以"周一见"事件为切入点,对名人隐私报道中的法律问题和伦理问题进行分析。从法律的角度看,尽管名人的隐私权由于其公众人物的身份需要进行部分让渡,但根据近些年来的判例,对名人隐私的保护力度有所加大;从伦理角度来看,保护个人隐私因关涉人格尊严一直是媒介伦理中的重要内容。本文提出在涉及名人的报道中应当以关怀伦理学为指导,对名人隐私进行必要的保护。

This article investigates the legal questions and ethical question in media's report of celebrity's privacy with a Chinese popular actor Wen Zhang's scandal as an example.From legal perspective,celebrity's right of privacy should be partly relinquished because of their status of celebrity,however,recent cases show that the protection of their privacy has improved.From ethical perspective,privacy is an important component in media ethics because of its close relationship with human dignity.This article argues that celebrity's privacy should be protected under the guidance of caring ethics.
