“媒体审判”的话语表达及规避路径

本文以中国现实语境中的"媒体审判"(新闻报道形成"审判预设",导致某种舆论压力,妨害和影响司法独立与公正的行为)问题为主要研究对象,就"媒体审判"之表现形态——显性表现和隐性表现进行了探究。论文结合近年来典型重大案件的新闻报道以及新闻媒体形态的演进,对新闻媒体所做出的"媒体审判"的要素做出重新界定,并就如何协调新闻媒体言论自由和司法独立之间的冲突做出了探讨。

This dissertation researches the phenomenon of trial by media in Chinese circumstances.In the dissertation,the various potential influences of trial by media on Chinese jurisprudence are analyzed in different perspectives.By using the existed researches for reference,the dissertation re-defines the elements of trial by media on the basis of analyzing the news reports on significant trials in the previous years.Finally,the disserta-tion probes into the balance between free speech and independent jurisprudence.
