The Affection of ISM Code on Seaworthiness

ISM规则(国际安全管理规则)已经在全球范围内对所有的船舶强制实施,它给海上运输的各方都带来了巨大的影响。笔者就规则对船舶适航内容的增加、对船东适航保证要求的提高以及对传统适航中各方责任分担的改变所产生的积极影响进行了论述,并指出由于规则的实施,在使船舶安全管理水平上了一个新台阶的同时,也过分增加了船东的适航保证责任。

ISM code has been enforced all over the world to all kinds of vessels, exercising a great influence on each party of the marine transportation. The author discusses the Code's influence on the new addition of the seaworthiness content,the increment of the shipowner's liability,the great change of the traditional distribution of the liability in seaworthiness, and also points out that with the improvement of the marine safety management, the Code puts the shipowner in a hard situation.
