国际风险资本进入中国的法律障碍与对策研究

Law Barriers and Suggestions of International Venture Capital in China

在中国风险资本有效供给不足的情况下,国际风险资本的进入对中国的风险投资业发展有着重要的作用。然而,尽管有数以百亿计的国际风险资本徘徊在国门外,由于中国现行法律的障碍,国际风险资本进入中国明显不足。文章首先阐述了国际风险资本进入中国的现状并分析了其成因,然后着重分析了国际风险资本进入中国的法律障碍,并对如何消除这些法律障碍提出了自己的建议。

In the light of the inadequate supply of domestic venture capital, it is indispensable for foreign venture capital to enter China and make up the inadequacy.However, the current law in China hampers the entry of tens of billions of international venture capital. The paper illustrates the present situation of the entry of foreign venture capital and its underlying causes, analyzes the barriers that block the successful introduction of foreign venture capital into China and puts forward suggestions to break down and eliminate those barriers.
