试论计算机软件的知识产权保护

从计算机软件诞生开始,经过几十年的发展,计算机软件已成为独立于计算机硬件的一个巨大的产业。特别是网络时代的到来,使得计算机软件的作用发挥得淋漓尽致。我国计算机软件产业起步较晚,软件产业在近年来虽然取得了迅速的发展,但是,距离发达国家的软件业发展水平仍然很大。另一方面,发达国家的软件专利保护的大趋势对我国现有的软件保护制度提出了严峻的挑战,所有这些现实情况都迫切需要我国在软件的保护模式上探求符合自己的途径。

From the birth of computer software,through the decades of development,computer software,computer hardware has become independent of a huge industry.In particular,the advent of the Internet age,making the role of computer software on its head.Computer software industry in China started late,the software industry,although in recent years has made rapid development,but from the level of development of the software industry in developed countries remains high.On the other hand,developed countries,the major trend of software patent protection of our existing software protection system presented a serious challenge,all of these realities,there is a pressing need for the protection of our country in the software model to explore ways to meet their own.
