摘要
《上海自贸区条例》被称为上海地方立法史上最具影响的"第一法",也是自贸区建设的"基本法"。《上海自贸区条例》既是对自贸区改革过程中所形成的可复制、可推广的制度经验的总结和提炼,也为自贸区改革的深入推进提供了更好的法制保障。本文分别从自主改革指导思想的贯彻、《上海自贸区条例》与众多授权立法之间的协调、行政异议制度的创新价值和推广意义以及《上海自贸区管理办法》的去向等方面,对《上海自贸区条例》和自贸区法治建设的相关问题进行了分析,以期引起更多学者的关注、探讨和追问,从而使其日趋完善,并形成更多可复制、可推广的立法经验,发挥其示范带动、服务全国的积极作用。
The Shanghai Free Trade Zone Regulations is called the most influential 'first law' in the history of Shanghai local legislation,and is also the 'basic law' of the free trade zone construction.It is a conclusion and abstract of the reproducible and propagable system experience formed in the process of the free trade zone reform,and also offers the better legal system guarantee to the deep boost of the free trade zone reform.The paper,respectively from the perspectives of the implement of the autonomous reform guiding ideology,the coordination between the Shanghai Free Trade Zone Regulations and a large number of the authorized legislations,the innovative value and the propagable significance of the administrative objection system as well as the direction of the Shanghai Free Trade Zone Management Methods and so on,carries on analyses on the relevant problems of the Shanghai Free Trade Zone Regulations and the free trade zone's legal construction in order to arouse more scholars' attention,discussion and questions, which accordingly makes the relevant problems improve gradually and forms more reproducible and propagable legislation experience to play its active part in the demonstration-promotion as well as serving the whole country.
