Reform of Administrative Approval Model:Connotation and Research Logic

行政审批模式变革为研究行政审批问题提供了新的视角。从理论上澄清行政审批模式及相关概念内涵是研究开展的逻辑起点,包括行政审批与行政许可的交替使用、行政审批模式与行政审批制度的概念区分等。本文认为,行政审批模式是行政审批的属性特征、系统结构和过程状态经过概括而抽象出来的标准样式。行政审批模式变革与行政审批制度改革本质上是一种对立统一的关系,从制度变迁的视角看存在强制性实现路径与诱致性实现路径两种方式,行政审批模式变革的最优路径应是二者的互动结合。

The reform of administrative examination and approval mode provides a new perspective for the study of administrative examination and approval.It is the logical starting point for the research to clarify the administrative approval model and its related concepts in theory,including the alternate use of administrative approval and administrative license,the conceptual distinction between administrative approval model and administrative approval system,etc.This paper holds that the administrative approval model is the standard style abstracted from the attribute characteristics,system structure and process state of the administrative approval.The reform of administrative examination and approval mode and the reform of administrative examination and approval system are essentially a unity of opposites.From the perspective of institutional change,there are two ways of compulsory realization and induced realization.The best way of the reform of administrative examination and approval mode should be the interactive combination of the two.
