摘要
员额测算是员额全局调整、员额区域统筹以及优化法院内部管理的决策工具。不同历史阶段,员额测算的推进主体、变革动因和方法选取特点各异。究其知识属性,员额测算属交叉学科,处于司法制度研究的边缘。究其事权属性,员额测算为司法行政事权,法院自行掌管呈现稳态。因此,员额测算知识生产和应用的封闭性应当打破,其作为调配增量资源的司法行政事权应当从法院自管事权中剥离。
Estimation of posts is a decision-making tool for t he overall adjustment of posts,the regional integration of Posts and the optimization of the internal management of the Court.In different historical stages,the main body,motivation and method of post estimation are different.In terms of its knowledge attribute,post estimation is an interdisciplinary subject and is on the edge of judicial system research.Investigate its property of power,posts are estimated to be judicial and administrative power,and the court is in charge of itself and presents a steady state.Therefore,the closeness of the production and application of post estimation knowledge should be broken,and the judicial administrative power as an allocation of incremental resources should be separated from the court’s self-management power.
