摘要
当下,在我国就业市场中,劳动者遭遇就业歧视的现象时有发生且愈加趋于'隐性化',如用人单位往往在劳动者中'择优而选'从而使众多劳动者因'条件不符'而被拒之门外。这种隐性就业歧视引起了社会的广泛关注,虽然国家也出台了相关政策加以治理,但尚未成熟的反就业歧视机制在应对这种隐蔽性更强的就业歧视时还显得有些力不从心。本文阐述了隐性就业歧视的表现形式、消极影响、成因以及世界范围内就业歧视法律治理状况,分析了我国隐性就业歧视法律治理存在的不足并提出了相应的建议,希望能够对我国隐性就业歧视的法律治理提供助力。
Employers often choose the best among many job seekers,which makes job candidates widely excluded because of'inconsistent conditions'.After causing widespread concern about discrimination in employment,the state took some measures to control it.At the same time,employment discrimination is gradually derived from explicit discrimination,which is implicit employment discrimination.This covert and stronger employment discrimination also makes it more difficult to manage.This paper expounds the background and reasons of the implicit employment discrimination,the negative effects of the implicit employment discrimination on society,the governance of the implicit employment discrimination,and some suggestions and improvement measures for the governance of the implicit employment discrimination.It is hoped that it can provide some help to recessive discrimination in employment.
