'协商决策'对于'听证决策'在公众参与行政决策落实上已呈现出深化论辩及合作面向上的优越性,在其程序构建中若完全满足结果实现与过程公正,将使程序体量过于臃肿而导致后续运作的操作困境,因而需要对不同且冲突的程序价值进行权衡考量。具体而言,针对'结果价值'与'过程价值'两类不同的程序价值,应基于对重要'结果价值'优先以及体现正当程序等理念的必要'过程价值'保留的综合考量,以实现法治化程序的经济构建。

'Consultation decision'has shown the superiority of deepening argument and cooperation in the implementation of public participation in administrative decision-making,and the realization of the process and the justice of the procedure will make the program volume too bloated and lead to the operation dilemma of the subsequent operation,so it is necessary to weigh the different and conflicting procedural values.In particular,on the basis of the consultation procedure aimed at dispelling differences,the two different procedural values of'result value'and'process value'should be based on the comprehensive consideration of the necessary'process value'reservations to the important'result value'priority and the embodiment of due process,so as to realize the economic construction of the legalization procedure.The introduction of conflict and trade-off analysis between different program values also avoids the bias of value orientation in the construction of decision negotiation procedure.
