摘要
我国现行刑法规定了有关黑社会性质组织的犯罪,其存在诸多不足,理应给予完善。从刑事实体法角度而言,应增加有关黑社会组织的犯罪,增设财产刑,把单位纳入黑社会犯罪的主体;从刑事程序法角度而言,应加强对证人保护,证据收集的手段应该扩大,应与其他国家签订赃款分割协议。
Our criminal law stipulates the crimes of organiztions in the nature of criminal syndicate, but the formulation is insufficient and should be perfected. From the view of criminal law, we should add the crimes of under- world society and property penalty, and also we should add units to the subjeet of gangland crimes. From the view of criminal procedure law, we should enhance the protection of witnesses, expand the measures of collecting evidence,and sign contracts about sharing bribes with other countries.
