从患者知情权谈医生如何履行告知义务

Discussion on performance of notification by doctors from the perspective of patients' right to learn the truth

《医疗事故处理条例》第 11条明确规定了医务人员的告知义务和患者的知情权 ,这一规定在强调患者知情选择权的同时 ,实际上隐含了医生履行告知义务时应当遵循的规则 ,即对患者无不利后果。实际工作中如何操作才能达到患者承诺权与医生自由决定权的完全平衡 ,作者提出几项建议 ,即应具备良好的职业道德素养 ,对病情应有客观的估计 ,要有实事求是的科学态度 ,应重视沟通技巧以取得患者信任 。

The eleventh article in “Rules for the Handling of Medical Malpractice” clearly defines the notification duty of medical personnel and the patient’s right to learn the truth. This article emphasizes patients’ right to learn the truth and to select accordingly, moreover it implies the rules that doctors must follow when performing their duty of notification, that is, none of potentially harmful outcome to patients should exist. In practice, it is uneasy how to manipulate this rule to reach a full balance between the patients’ right of acceptance and doctors’ right to make free decisions. In this regard, the author of the paper offered several proposals. Firstly, medical staff should possess good accomplishment of professional ethics. Secondly, they should scientific and realistic approach to the state of illness. Lastly, they are expected to attach great importance to communication skills to enjoy the trust of the patients and to leave some margin with the unpredictable outcome of diseases.
