摘要
传统“婚姻”概念是指男女两性间的一种社会关系 ,但随着社会发展和科技进步 ,越来越多特殊的婚姻问题得以涌现 ,如变性人、同性间的关系等 ,对此是否能称之为“婚姻” ,我国无明文规定 ,各国对此观点也不尽相同。笔者统称这些有别于传统意义上的婚姻为“特殊婚姻” ,仅作法律意义上的前瞻性探讨。
The traditional marriage concept refers to the social relationship between men and women.But with the development of the society and the science,more and more problems of special marriage are emerging,such as denaturalisation,homosexuality.There is no legal basis on whether they are called'marriage'or not and there are different viewpoints in different countries.The author generally calls them'special'marriage',only as the fore probe in a legal significance.
