摘要
道德与法律的关系 ,在人类历史上经历了一个由高度融合到相对独立 ,再到重新融合的过程。一方面 ,道德是一个历史的范畴 ,不同历史时期的道德具有不同的价值定位标准。另一方面 ,道德价值又具有社会本位性 ,即以社会的总体认可和支持为前提和基础。要充分发挥道德维系伦理关系的功能 ,就要对道德进行制度化设计。适当地把道德法制化有其必要性和现实意义。实行依法治国 ,建设社会主义法治国家 ,法治运行中的立法、执法、司法、守法各个环节都要求加强道德建设。
In human history,morality and the law have experienced a process from highly blending to relative independence,and then to blending again.On the one hand,morality belongs to history category.Morality has different standard of value in different period of history.On the other hand,moral value has social nature,that is :the premise and foundation approved and supported generally by the society.We should design morality in systematization, to bring into play the function of morality maintaining ethic.It's necessary and of practical or immediate significance to make morality into institutionalization properly.To put running a country into practice and build up a socialist country governed by law,every link in legislation,enforcing the law, justice and keeping the law requires strengthening moral construction.
