摘要
文章以非法证据的两个特征:证明力、非法性为基点,挖掘它们之中的法价值,用价值比较的经济学方法分析非法据证排除规则,并提出一些具体措施。
This article finds the values of security and liberty from the ability of proving the legal fact and illegitima- cy of illegal evidence.It then analyses the exclusion rule of illegal evidence with comparing liberty and security by eco- nomics'means and put forward a few solutions
