中西方法治思想差异比较及原因分析

On the Differences between Chinese and Western Thought about the Rule of Law

中国之所以难以如西方社会一样走向法治进程,从历史比较的角度看,其原因在于中西方法治观念之间存在着巨大的差异。中西方社会不同的自然地理环境、经济基础和政治基础等是差异形成的原因。

Large differences exist between Chinese and Western thought about 'rule by law' which mainly include two aspects. The foundation of the Chinese thought is that laws should change with the social changes but laws should remain rational and right forever in the West. While enforcing the law, China admits someone to surpass it but the West allows nobody to do so. Causes for the differences are also given in this paper which involve the natural environment, economic and political conditions.
