主办警官办案责任制——建立公安机关执法主体资格制度的新探索

Sponsoring police officer responsibility system of handling a case——the new explorations of setting up the subject qualification system of enforcing the law for the public security organ

为了端正公安民警的执法思想,规范公安民警的执法行为,提高执法质量,真正落实办案责任制,从根本上解决执法不严、超期羁押、办案质量差、批捕起诉率低等问题,以达到提高公安机关整体执法水平的目的,2001年2月,郑州市公安局金水分局依据《中华人民共和国刑事诉讼法》、《公安机关办理刑事案件程序规定》、《中华人民共和国行政处罚法》、《中华人民共和国治安管理处罚条例》、《中华人民共和国警察法》等有关法律、法规和部门规章,结合工作实际,制定并推行了主办警官办案责任制。所谓主办警官办案责任制是指在公安分局行政首长领导下,以主办警官为执法责任人的一种执法办案责任制。从出发点上说,“主办警官制”赋予执法办案责任制崭新的含义,并以此作为公安队伍建设和业务成效的最佳结合点,进一步引领公安工作步入良性发展的轨道,真正实现“立警为公,执法为民”的要求。截至2003年10月,经过两年多的实践与完善,尤其是随着时间的推移和各种相关制度的完善与落实,金水公安分局的“主办警官制”已步入良性运作轨道并显示出巨大的优越性,不仅极大地规范了全体民警的执法行为,而且大幅度地提升了公安民警的执法水平,提高了执法质量和执法效率。日前,本刊就学界与实务界争论的热点问题,专门采访了河南省郑州市?

In order to correct the polices of public security men's thought of enforcing the law, standardize the polices of the public security men's behavior of enforcing the law, raises the quality of enforcing the law, solve the problems as followers: not strict in enforcing the law, extend detention,etc., achieve the goal of raising the whole competence of enforcing the law the purpose for the public security organ. Since February of 2001,according to the relevant laws,the regulation and department rules like 'Criminal Procedure Law of the People's Republic of China','the public security organ handles the criminal case to stipulate', 'administrative penalty law of the People's Republic of China','the public security is managed and punishes the regulations of the People's Republic of China','police law of the People's Republic of China',combines reality of work,Jinshui police branch station of Zhengzhou city public security bureau pursued 'the system of the responsible police-officer'(hereafter referred to as 'sponsor police officer system').The so-called 'sponsor police officer system'refers to under the leadership of the leader of the branch public security bureau,make police officer as the' person liable of enforcing the law while handling a case. Saying from starting point,'the system of the responsible police-officer'giving the system of enforcing the law and handling a case responsibility brand-new meaning ,then regard this as the best combinations for the team construction and business effects, lead public security work step into the tracks of developments further .Realize the request that'being a police for the public, enforce the law for the people'.Up to October 2003, through two years' exercises and perfection,especially,the relevant systems perfection and implementations as time goes on, 'the system of the responsible police-officer' of Jinshui police branch station has already step into the benign operation track and demonstrated enormous superiority. It standardize the behavior of enforcing the law of all polices,but also promoted the polices of public security competence of enforcing the law by a large margin greatly, raised the quality and efficiency of enforcing the law. A few days ago,in view of the focus issue this publication interviewed Yang Yuzhang, the associate chief of the public security bureau of Zhengzhou city,and several experts and scholars to discuss together.
