浅谈构建刑事非法证据排除规则

刑事非法证据的取舍问题,是近年来法学界争论的焦点。我国建立非法证据排除规则,应借鉴国外现行刑事法律中非法证据排除规则,结合我国国情,修改现行刑事诉讼法,确立与完善刑事诉讼非法证据排除规则。

In recent years, admission or exclusion of illegally obtained evidence receives great attention. Establishment of evidence exclusion rules in China should borrow ideas of exclusion rules in effect from foreign countries. According to practical situation of China, Criminal Law in effect is supposed to be amended to establish rules providing for exclusion of illegally obtained evidence.
