摘要
国有企业的规制改革是部门行政法的重要内容。行政规制应当以市场为基石,变革简单的行政命令模式,引入以行政指导、行政合同、行政奖励等非权力手段,建立起透明度高、审批手续简化、行政参与机制发达、救济保障体制健全的非强制性规制模式。
Regulatory reform on State Enterprise is an important task for the department of the administrative law. Regulation must be based on the market and should be transformed from the compulsory model to the non-compulsory model which characterized by high’ transparency, simplified examine and approve procedure, advances participation system and perfect remedy institution. It depends on some soft measures like administrative guide,administrative contract,and administrativereward.
