WTO体制下环境与贸易问题的协调

Harmonization of environment protection and free trade in WTO

随着经济全球化的发展 ,环境保护和自由贸易的冲突已成为引人关注的重要议题之一 ,而WTO现有规则在处理类似冲突时捉襟见肘。WTO的发展必须兼顾自由贸易和可持续发展两大利益 ,这要求WTO在坚持自由贸易原则的同时 ,必须发挥争端解决机制的司法和借助国际环境立法的共同作用 ,才能在多边贸易体制下实现环境保护和自由贸易的协调。从这个观点出发 ,作者对中国在WTO体制下应对环境与贸易的冲突问题提出了建议。

With the globalization of world economy, the conflict between environment protection and free trade is more and more compelling. But the living regulations of WTO are too simple to help it out of this dilemma. We can find some useful principles in handling this problem in a worldwide scale by using the dispute settlement body of WTO and establishing international environment protection law. In this article, the authors give some practical suggestions to harmonize the conflicting two sides: environment protection and free trade. And the authors also give suggestion to help China in dealing with the problem.
