适合国际化大都市的环保执法工作新机制探讨

Approach on New Working Mechanism of Law Enforcement forProper Internationalized Metropolis

环保执法是政府环境保护行政主管部门对环境保护工作统一监督管理的主要抓手之一,是实现环境质量根本好转的重要手段。文章从环保法律体系、环保法制建设、政府环境管理体制、市区两级环保部门执法现状等方面,分析了上海市环保执法的现状及存在的问题。从完善环境保护法律法规、强化经济手段、解决环保执法监督机制和工作机制、实行执法效能评估、健全环保执法监督制约机制等方面,提出了建设性的对策建议。

Environmental law enforcement is the major grisp of unifying supervision and management on environmental protection work for department in charge of Government Environmental Protection Administration, and an important measure of realizing environmental quality improvement basically. In this article, analysis on the status quo of environmental law enforcement and existing issues from environmental legal system and construction of environmental legal system, government administration system and law enforcement situation of municipal and district levels etc. were presented, to propose constructive countermeasure and recommendations from ameliorating regulations and law of environment, strengthening economic measure, resolving environmental law enforcement supervision mechanism and working mechanism, implementing apprasial of effect of law enforcement and perfecting environmental law enforcement supervision mechanism etc.
