对河南省司法鉴定体制改革中有关鉴定权问题的思考

当前我省所进行的司法鉴定体制改革归根结蒂是司法鉴定权的改革,近年颁布实施的《河南省司法鉴定管理条例》主要在司法鉴定的管理权、决定权以及执行权三个方面进行了卓有成效的改革。但同时,这些改革还存在一定局限性,如在司法机关内部鉴定机构受理鉴定上缺乏必要的限定,长期以来反映强烈的“自审自鉴”等现象仍会继续存在下去,需引起高度重视。

Now,the system reform of the expert testimony in our province is the reform of the expert testimony power in the final analysis.The newly implemented Henan Expert Testimony Management Ordinance has made highly effective reforms in the management power,decision making power and execution power of the expert testimony.However,the reforms still have their own limitations.This article mainly deals with the problems of trying and appraising the cases by the same group of people.
