浅析我国刑事被害人精神损害赔偿的现状及缺陷

A Tentative Study on Status Quo and Drawbacks of Victim’s Compensation for Mental Health Impairment in Criminal Cases

在人类发展、社会进步的现代社会中,人们越来越重视自身的价值和人格尊严。人权保障制度也得到进一步发展,其中关于精神权利的司法救济也不断完善,本文从立法、司法解释和司法实践三个方面阐述我国刑事诉讼领域的刑事被害人的精神损害赔偿问题,分析了我国司法机关的做法,并在此基础上质疑我国现行制度的缺陷。

In a developing modern society,people more and more care about their individual’s value and dignity.Human rights protection system has been improved including the judicial aid in mental rights.This article makes a tentative study on victim’s compensation for mental health impairment in the field of criminal lawsuits from three aspects of law making,judicial definitions and judicial practices,analyzing the actions of our judiciaries and examining the drawbacks in our existing system.
