论高等教育的法治化路径

在政府主导下,中国高等教育改革取得重大进步,但高等教育治理过程中的纠纷亦逐渐复杂频发。总体而言,中国高等教育具有大众化、现代化、司法化的治理特征。最新《中华人民共和国高等教育法》明确规定,高校面向社会依法自主办学充分实现市场化、校内学术治理主导地位、校外接受政府监督,为高等教育治理提供法律治理框架。据此,高校应通过制定和完善其章程,以落实现代法人治理机制、落实内部权力相互制衡和相互协调管理,政府应当坚持依法行政,审慎行使监管权。

In general, China’s higher education has the characteristics of popularization, modernization and judicialization. The latest "Higher Education Law of the People’s Republic of China" clearly stipulates that colleges and universities for the autonomy of the school according to the law to fully realize the market, the academic leadership of the school, outside the government to accept the supervision of higher education governance to provide legal management framework. According to this, colleges and universities should formulate and improve their charter to implement the modern corporate governance mechanism, the implementation of internal power checks and balances and mutual coordination and management, the government should adhere to the administration of law, prudent exercise of supervision.
