论全国性法律在香港特区的实施——基于对《香港基本法》第十八条的分析

On the Enforcement of National Laws in Hong Kong SAR——Based on the Analysis of Article 18 of the Basic Law of Hong Kong SAR

在法律文本上,"全国性法律"是特别行政区基本法中的一个特有的概念。《香港基本法》第十八条对全国性法律在香港特区的实施进行了规定。根据该条第二款和第四款的规定,全国性法律主要通过两种方式在香港特区实施,这两种实施方式存在较大不同。全国性法律在香港特区的实施,对维护国家主权、统一和领土完整具有至关重要的意义。应当加强对全国性法律在香港特区实施的研究,完善全国性法律在香港特区实施的方式。

Article 18 of the Basic Law of the Hong Kong SAR is about the enforcement of national laws in the Hong Kong SAR. According to the provision of Article 18(2) and 18(4),national laws are enforced in the Hong Kong SAR in mainly two ways, which greatly differs. The enforcement of relevant national laws in the Hong Kong SAR plays an important role in maintaining the sovereignty, unification and territory integrity of our country. We should enhance the study of the enforcement of national laws in the Hong Kong SAR and improve the ways of the enforcement of national laws in the Hong Kong SAR.
