Study on the System of Lawyers' Access to the Legal Profession in Macao

在澳葡时期,澳门颁布了《律师通则》等一系列法律文件,建立了本地区的律师制度。澳门律师制度特色鲜明,如律师独立自由执业、内部没有等级之分、不受制于任何公共行政部门或实体等,律师服务对促进澳门司法公正起到了不可或缺的积极作用。回归16年以来的实践表明,为适应"一国两制"的发展需要,澳门律师制度有待改进,其中律师入职条件的设置等制度,更受到各方关注,亟需进一步规范和完善。为此,可以尝试建立统一的司法考试制度,加强律师的教育培训,提升律师的双语水平,激励更多律师取得内地的律师资格,为澳门律师业的未来发展找到一条出路。

In the period of Portuguese government, Macao promulgated the'Lawyer'Statute'and a series of legal documents, and the lawyer system was established. Macao's lawyer system has distinctive features, such as lawyers can practice law independently and freely, there is no internal hierarchy,and lawyers are independent of any public administrations or entities. Lawyers' services have played an indispensably crucial role in promoting justice in Macao. Practice of the 16 years since its return to the motherland has shown that Macao's lawyer system should be improved to meet the'One Country, Two Systems'development needs, in which the requirements for lawyers' access to the legal profession are the concerns of various parties and desperately need to be further standardized and improved. Therefore, a unified judicial examination system could be established to enhance the education and training of lawyers. The bilingual ability of lawyers should also be improved. More lawyers should be encouraged to obtain the qualification for lawyer in the hinterland in order to find a way for the future development of the legal profession in Macao.
