摘要
以淘宝和国家工商总局交锋为例研究中国电子商务监管体制,介绍中国电子商务监管的现状:电子商务发展现状、政府监管的现状及问题的严重性。然后从立法刚处于起步阶段、多头监管、过度依赖政府,没发挥社会和市场力量、电子商务的特殊性所需技术、人员、设备不足等角度分析中国电子商务监管存在问题,再以阿里巴巴和国家工商总局的博弈过程印证上述原因,并在以上基础上提出对策建议:完善建立相关监管法律法规、明确监管职责权限、完善监管方式以及政企良好互动。本文基于行政管理的角度进行分析以期实现中国电子商务从野蛮生长到规范发展。
In taobao,and the state administration for industry and commerce as a case study of Chinese ecommerce regulatory system,introduces the present situation of the China electronic commerce regulation:electronic commerce development present situation,the current situation of government regulation and the severity of the problem. Just in the initial stage and then from the legislation,regulatory fragmentation,excessive reliance on the government,not play to social,market forces,the particularity of e-commerce technology and the shortage of personnel,equipment needed for Angle analysis and regulation of China's ecommerce,in the game process between alibaba and the state administration for industry and commerce to confirm the above reasons,and put forward countermeasures and Suggestions on the basis of the above:establishing related regulatory laws and regulations,and improve the good interaction. This article is based on the angle of administrative management is analyzed in order to achieve the development of Chinese e-commerce from the savage growth to specification.
