中国法律演进的历史时空环境

Historical Environment of Evolution of Chinese Law: Time and Geographical Elements

近代西方的世界性扩张不仅在地理空间方面结束了各古老区域性文明的相互隔绝状态 ,实现了全球范围内的关系整合 ,也在时间方面结束了各古老民族的循环时间观念的命运 ,把西方工业化社会内部所呈现的以“历史进步”为特征的线性时间逻辑客观地强加于各古老民族。在西方扩张的进程中 ,中国社会与法律和其他非西方民族的情况一样 ,成为“扩张”和被“挤压”的对象。本文借助人文地理学家戴维·哈维 (DavidHarvey)“时空压缩”概念并加以适当转换 ,提出了“时空挤压”理论 ,用以描述中国近现代法律演进的历史时空环境。

The Western expansion in the centuries not only ended the isolation of the ancient cultures but integrated the world geographically, but also ended up the idea of the ancient nations the in terms of time by imposing the lateral time concept historical progress of the Industrial world onto them., and so onto China, making China a object of expansion and pressing. This article, by using humane geography scholar David Harvey's concept of “time and space press” and make a change of it to raise the corresponding theory to describe the historical environment of evolution of Chinese Law.
