中国城镇住宅共有资源自治的可能性

Possibility of the Self-governance of the Common Resources about Urban Dwelling Houses in China

本文针对中国城镇住房制度改革中的住宅小区物业,考察共有资源产权制度,讨论小区共用部位等资源因共有而“共享、共治、共担责任和义务”的问题。分析表明,存在业主共有产权自治安排的可能性,这种自治制度可以使城镇住宅共有资源避免出现“公地悲剧”的结局。

In view of the property management which has taken place since the reform of the urban dwelling house system in China, this paper analyses the institution of CPR property rights (common share and duty, and common governance on the common resources in residence), showing that it is possible to form the self-governing institutional arrangements, of common property rights by the house-owners, and 'the tragedy of the commons' will not emerge again.
