诚信与公法关系探讨

On Relationship between Bona Fide and Public Law

诚信不仅适用于民商法 ,在公法领域也同样适用。宪法中应该坚持诚信原则 ,制定宪法要诚实 ,实施宪法要守信。诚信是刑法的内在道德要求 ,在刑法中通过一系列原则规定、制度设计、罪名安排等得以体现 ,并且刑法通过特有的内容和手段 ,推动诚信在全社会的建立。随着行政法的发展 ,诚信也逐渐成为行政法的一种内在要求。

Bona fide is applied to public law as well as civil and commercial law. Bona fide doctrine should also be abided by in the constitution. That is to say, the constitution should be made honestly and carried out faithfully. And bona fide is also internal moral requirement of criminal law, which is reflected in its basic principles, various criminal systems, and accusations. Furthermore, criminal law pushes forward the establishment of bona fide in society through its special content and means. With the development of administrative law, bona fide has been becoming its internal requirement, too.
