盗窃罪的经济学分析

Economic Analysis of the Crime of Theft

在法律经济学三个基本假设的基础上,利用经济学中的利润最大化原理,对盗窃犯罪的决策过程进行了深入剖析;然后在进一步分析的基础上,对盗窃罪最佳制裁方案的设计,给出了具体的计算方法:通过求出阻止盗窃犯罪的有效解,就可以制定出最佳的制裁方法。

On the basis of three assumptions of economics of law, this paper, by adopting the principle of profit maximization, anatomizes the decision-making process of committing the crime of theft, and then gives the concrete calculating methods of how to design the optimal punishment on criminals of theft——the optimal punishment can be designed by finding the efficient solution to the deterrence to theft crime.
