论我国计算机犯罪立法的完善

Discussion on Perfection of Legislating in Terms of the Computer Crime in Our Country

计算机犯罪对我国现行刑法典、刑事诉讼法典及其它法律规范产生了较大冲击。本文根据当前计算机犯罪的现状,对计算机犯罪的概念进行了界定和探讨,并在分析我国计算机犯罪立法现状和借鉴国外发达国家相关立法模式和立法特点的基础上,从完善我国防范和打击计算机犯罪立法的制度和措施方面提出了具体的建议。

The computer crimes have brought great attacks to our present penal code,code of criminal procedure and other legal regulations.Based on the current situation of the computer crimes,the paper defines and discusses the conception of the computer crimes.Drawing lessons from the related legislative code and characteristics in some developed countries,the paper also analyzes the current legislative situation of the computer crimes.From the aspects of improving the legislative systems and measures against the computer crimes,the paper finally puts forward some concrete ideas.
