论示范法模式在我国区际司法协助中的运用

On the Application of Model Law in the Inter-regional Judicial Assistance of Our Country

区际司法协助,是中国恢复对香港和澳门行使主权后最迫切需要解决的问题之一。现今在我国区际司法协助实践中已经出现了“安排模式”,这种模式初步解决了我国的区际司法协助问题,但还不能说是我国开展区际司法协助的惟一模式。中国区际司法协助的独特性和复杂性,使示范立法模式有其运用的空间。对此我国已出现了相关的实践及理论论述。在比较国外做法的基础之上,进一步探讨示范法在区际司法协助中的运用,对我国具有独特意义。

Inter-regional judicial assistance is one of the most important and urgent problems after the return of sovereignties of H.K.and Marco.At present,'settlement mode'has emerged in the practices of the inter-regional judicial assistance of our country and provided a preliminary solution for the assistance.However,it is yet exemplified as the sole mode in implementing inter-regional judicial assistance.In addition,the unique and complex qualities of the assistance widen the horizon of adopting the model law pattern,bringing out relevant theories and practices in our country.On the basis of comparisons of foreign operations,this paper further expounds the application of model law in the inter-regional judicial assistance,thus possessing great meanings.
