当代中国法治国家的目标探讨

A Probe into the Objectives of China's Nomocracy at Present

在学习《法理学教科书》相关内容的基础上进行了拓展性探讨。以当代中国的法治需要为基点,认为当代中国法治国家的目标应该包含实质正义和形式正义,可从6个方面去理解当代中国法治国家的目标体系。(1)保障权利;(2)制约权力;(3)立法民主;(4)法律至上;(5)司法公正;(6)依法行政。

This paper attempts to enrich the content of textbooks for jurisprudence, and on the basis of the requirements for China's nomocracy at present, holds that the objectives of China's nomocracy at present should include formal justice and nature justice, covering six aspects: (1) protection of rights; (2) control of powers; (3) democracy of legislation; (4) supremacy of laws; (5) judicial justice; (6) legal administration.
