突破涉外产品质量侵权案件法律适用的困境——三峡民工讼案调解经验的启示

我国在处理涉外产品质量侵权案件存在适用法律和判决承认与执行两个方面的困境。2003年武汉市中级人民法院成功地运用调解制度处理了一起涉外产品质量侵权案件,在某种程度上,突破了我国涉外产品质量侵权案件法律适用的困境,给我们以很大的启示。

There have two dilemmas in application of law and recognition and enforcement foreign judgments when dealing with foreign products torts cases in China.Wuhan Intermediate People’s Court successfully applied mediation system to deal with one foreign product torts case.It overcame the dilemma of application of law in foreign product torts case and gave us a lot of inspirations.
