On the System of Arbitrators’Disclosure

仲裁员在接受指定以及在整个仲裁程序中应该是公正的,并且独立于当事人。仲裁员的独立性与公正性不仅直接关系仲裁的公正与效率,还是制约仲裁制度发展的一个关键因素。在保障仲裁员的独立性与公正性的一系列制度中,仲裁员的披露制度发挥着重要作用。本文通过研究仲裁员披露制度来探讨我国仲裁员披露制度的建立与完善,并对我国如何构建仲裁员披露制度提出建议。

Every arbitrator shall be impartial and independent of the parties at the time of accepting an appointment to serve and remain so during the entire arbitration proceeding.Independence and impartiality of arbitrator not only influences the fairness and efficiency of arbitration,but also is a key factor which affects the development of arbitration.Disclosure is very important in the system of arbitrators’impartiality and independence.This article tries to discuss the system of arbitrators’disclosure,probe to design the system of arbitrators’disclosure in china.The author gives proposals for the designation of disclosure system in China.
