中国仲裁公信力建设的侧面思考

公信力不够是当前我国仲裁发展的主要问题。这一方面是因为仲裁机构在当地政府财政支持和行政级别待遇保障下自身改革动力不足,也是因为缺乏竞争压力所致。因此,要提高我国仲裁公信力,就应当引入竞争机制促使仲裁机构改革完善自身管理机制和运行模式,大幅度提高仲裁员报酬、建立'半职业化'的高素质仲裁员队伍,建立动态的、科学的仲裁员考评机制。这是在不修改仲裁立法的情形下,可能提升我国仲裁公信力的有效途径和方法。

The insufficient credibility is the main problem in the current arbitration in China.This aspect is due to the lack of motivation for the reform of the arbitration institutions under the financial support of the local government and the protection of the administrative level.On the other hand,it is also due to the lack of competitive pressure.Therefore,in order to improve the credibility of arbitration in China,we should pull-in a competition mechanism to promote the arbitration reform and improvement of its own management mechanism and operation mode,greatly improve the compensation of arbitrators,establish a'semi-professional'team of high-quality arbitrators,and establish a dynamic and scientific Arbitrator evaluation mechanism.This is an effective way and method to improve the credibility of arbitration in China without modifying the arbitration legislation.
