提升仲裁公信力的道德对策

凡是有公共权力运用的地方,都有公信力建设的问题,公共权力包括行政权力、执法权力、司法权力、话语权等,所有具有公共管理、公共服务等职能的部门都应当加强公信力建设,包括政府公信力、媒体公信力、司法公信力、企业公信力、社会公信力等。仲裁机构拥有仲裁权,无疑应当加强仲裁公信力建设,党的十八届四中全会指出:'完善仲裁制度,提升仲裁公信力。'仲裁公信力就是让仲裁当事人信任、信服,让社会安定的力量。仲裁公信力提升的路径有多种,从道德对策进行思考,加强仲裁员职业道德建设,提升仲裁公信力,可以采取如下三大对策:构建仲裁员职业道德基本准则体系,强化仲裁员的廉洁自律,加强对仲裁员的多元监督。从而塑造、提升仲裁员的爱国为民情怀。

Wherever public power is used,there is a problem of credibility construction.Public power includes administrative power,law enforcement power,judicial power,and even discourse power.All departments with public management and public services should strengthen credibility,including government credibility,media credibility,judicial credibility,corporate credibility,social credibility and so on.Arbitration institutions have the right to arbitrate,and undoubtedly should strengthen the construction of arbitration credibility.The Fourth Plenary Session of the 18th CPC Central Committee pointed out:'Improve the arbitration system and enhance the credibility of arbitration.'The credibility of arbitration is the power that allows the arbitrators to trust,convince,and secure the society.There are many ways to improve the credibility of arbitration.From thinking about moral countermeasures,strengthening the construction of arbitrators’professional ethics,and improving the credibility of arbitration,the following three countermeasures can be taken:constructing the basic standards system for arbitrators’professional ethics,strengthening the integrity and self-discipline of arbitrators,and strengthening Multiple supervision of arbitrators.Thereby shaping and improving the patriotism of the arbitrators.
