中国家事审判改革及家事审判立法——兼谈对台湾地区“家事事件法”的借鉴

Deepening the Reform of Family Trail and Its Legislation ——Referred to the Enlightenment of Taiwan‘Family Cases Law’

我国大一统《民事诉讼法》框架下没有设置独立的家事审判制度,2018年最高人民法院公布《深化家事审判改革意见》(试行)催生了构建独立家事审判法的议题。总结我国家事审判方式和工作机制改革实践经验,梳理最高人民法院关于家事审判改革的意见规定,借鉴我国台湾地区2012年颁布实施的'家事事件法'的有关核心制度,对大陆地区家事审判组织和法官及辅助人员的设置、家事审判案件范围和种类的划分、家事审判调解程序的前置及与家事裁判程序关系、家事审判诉讼和非讼程序的分化及诉讼法理的交错适用等提出合理化立法建议。

In China's Mainland,there is no independent family trail system set up under the frame of our unified‘Civil Procedure Law’,while‘The Guidelines on Deepening the Reform of Family Trail’(Trial Implementation)made by Chinese Supreme Court in 2018 forced the agenda that family trail system should be designed separately.Hopefully,this can provide some reasonable suggestions on how to set up China's Mainland’s family trail institutes,judges and ancillary judicial personel,divide the class of scale and category of family trail,coordinate the relationship of family trail proceedings and pre-mediation proceedings,distinguish the litigation and non-litigation of family judgment procedures and interlace procedural jurisprudence and non-procedural jurisprudence in proceedings as well,by summarizing Chinese family trail mode and experiences of family trail reform,teasing out the regulations in Chinese Supreme Court’s guidelines and referring to the core system of Taiwan‘Family Cases Law’(2012).
