中国刑事证明理论体系的回顾与反思

The Retrospection and Reflection on the Theoretical System of Criminal Proof in China

在借鉴和移植前苏联、西方国家刑事证据法学理论的基础上,我国先后形成了以广义刑事证明观、狭义刑事证明观为基础的刑事证明理论体系。尽管我国刑事证明理论研究已经取得了丰硕研究成果,但是在刑事证明理论仍然较为混乱的情况下,理论界只是在形式上形成了较为系统的刑事证明理论体系,而在内容上却尚未形成权威的、公认的、成熟的刑事证明理论体系。为了科学构建具有中国特色的刑事证明理论体系,理论界亟待从研究思路、研究方法、研究内容等方面实现刑事证明理论的研究转型,回归刑事证明研究的本质使命,强化刑事证明研究的主体品格,调整刑事证明结构的研究重心。

After learning and transplanting criminal evidence law of the former Soviet Union and western countries,theorists successively formed a criminal proof theoretical system based on the generalized and narrow concepts of criminal proof in China.Objectively speaking,China’s criminal proof theory research has achieved fruitful research results.However,where criminal proof theories are still very confused,the theoretical circle has only created a systematic criminal proof theoretical system in form,and has not formed a authoritative,recognized,and mature criminal proof theoretical system on the content.In order to scientifically construct a criminal proof theory system with Chinese characteristics,the theoretical community urgently needs to realize the research transformation of criminal proof theory from the aspects of research ideas,research methods and research contents.Specifically,theorists shall return to the essential mission of criminal proof research,strengthen the subjective character of criminal proof studies,and adjust the research focus of criminal proof structure.
