Jurist Wang Chonghui's Thought and Academics

王宠惠的治学领域涉及宪法、刑法、民法等学科,并对司法改良提出过具体的意见;他是中国法律学者中最早具备比较法视野的人,但留下的著述多为通论性质或绍介性质,学术含量一般;随着时代进步和学理发展,很快成为明日黄花。从学术谱系来看,王宠惠是现代中国第一代法学家中的佼佼者,他以点滴的著作和法律实践为群策群力建设的中国现代法学大厦贡献了块砖片瓦。他具有成为一代法学大家的资历与机遇,他具有创造法学新典范的天时与地利,然而囿于时势,终无大成。随着1920年代治学专门的第二代法学家登上历史舞台,王宠惠的学术很快被后起之秀超越了。

Wang Chonghui’s field of study involves constitution,criminal law,civil law and other disciplines.He also has unique insights on judicial reform.He is the first Chinese legal scholar to have a comparative perspective.However,his writings are mostly general theory or introduction.With the progress of the times and the development of academics,his writings is quickly out of date.From the perspective of academic pedigree,Wang Chonghui is the leader of the first generation of modern Chinese jurists.He contributes a piece of brick and tile to the modern Chinese legal science by the works and legal practice.He has the qualifications and opportunities to create a new paradigm of legal science and become a great jurist.But he does not seize the opportunity.With the advent of the second generation of jurists in the 1920 s,Wang Chonghui’s academics are quickly surpassed.
