论执行团队理念下立审执一体化的制度探索——以我国民事执行配置权演化进路为视角

On the System Exploration of the Integration of Trail and Execution in the Concept of Executive Team——Analysis from the Perspective of the Evolution of Civil Execution Allocation Rights in China

我国民事执行权配置经历了从"审执合一"到"审执分离"的发展过程,但在现有"审执分离"模式下,我国执行权配置模式正面临公正和效率双重困境的考验。目前我国存在的基于法院内部机构的横向探索模式和基于上下级法院的纵向探索模式并不能有效解决我国"审执分离"模式下的执行问题,且其本身也面临制度逻辑矛盾与违背法律规定等问题。"立审执"一体化的制度探索是在不突破现有"审执分离"的现状下,将审判团队和执行团队两者进行制度功能的衔接和整合,将可能涉及的执行"因子"渗透进立案、审判和执行的各个环节,充分实现审判与执行的有效恰接,从而达到对"执行难"问题的破解。江阴法院的"立审执"一体化的探索经验值得借鉴。

The allocation of civil execution power in China has experienced the development process from'the unity of trial and execution'to'separation of trial and execution'.However,under the existing'separation of trial and execution'mode,China’s executive power allocation model is facing the double dilemma of justice and efficiency.At present,the horizontal exploration mode based on the internal organs of the court and the vertical exploration mode based on the lower courts in China cannot effectively solve the execution problems under the'trial and execution separation'mode in China,and they also face institutional logic contradictions and violations of legal regulations.The system exploration of'trial and execution'integration is to reconcile and match the system functions of the trial team and the executive team without breaking through the existing'trial and execution separation'.The concept of the execution of the'factor'may be involved in the investigation,trial and execution of all links and fully realize the effective convergence of trial and execution so as to solve the problems in execution.The exploration experience of Jiangyin People’s Court’s'trial and execution'integration is worth learning.
