我国商会与法院联动调解民商事纠纷机制研究 被引量:1

On the Mechanism of Civil and Commercial Disputes Mediated by Chamber of Commerce and Court in China

摘要 在'大调解'和积极打造共建共治共享的社会治理格局的语境下,不少地方积极探索建立了以法院为主导、商会积极参与调解民商事纠纷的联动机制,但法院调解社会化的快速推进与商会调解体系缓慢重塑的矛盾,阻碍了法院与商会联动调解民商事纠纷的改革进程。通过学习与借鉴德国在强化商会组织建设、完善调解制度的经验基础上,提出了'一个前提、一个关键、一个方向、一个保障'的完善建议,即健全商会调解组织体系,加强落实'司法推动',着力发展调解的专业优势,建立激励保障机制。 In the context of'large mediation'and the active building of the shared social governance structure,many places have actively explored the establishment of the joint mechanism of the court as the leading and the chamber of commerce actively participating in the mediation of the civil and commercial disputes.However,the contradiction between the rapid development of the mediation of the court and the slow remolding of the mediation system of the trade association has hindered the reform process of the court and the chamber of commerce in the mediation of the civil and commercial disputes.On the basis of learning and drawing lessons from the experience of Germany in strengthening the organization construction of the Chamber of Commerce and perfecting the mediation system,this paper puts forward some suggestions on'one premise,one key,one direction,one guarantee',that is,perfecting the mediation organization system of the Chamber of Commerce,strengthening the implementation of'judicial promotion',developing the professional advantages of mediation and establishing the incentive and guarantee mechanism.
