Study on the non-litigation settlement mechanism for consumer financial disputes

摘要 随着消费类金融纠纷数量的不断上升,如何通过建立系统、多元的消费类金融纠纷解决机制来保护金融消费者权益、提升金融市场效率?构筑一个立体的、诉讼和非诉讼并存的金融消费纠纷解决机制势在必行。消费类金融纠纷具有自己的显著特征:一是涉及主体广泛,易激发群体性事件,金融机构若处理不当,则会对自身产生较大的声誉风险;二是专业性突出,对裁判者要求较高,裁判者不仅需要具备法律知识和审判技巧,而且还要熟悉这个行业领域的惯例和交易习惯;三是总量较大,但个案争议金额相对较小。 Under the circumstance that the number of consumer financial disputes has kept rising,how should the rights and interests of financial consumers be protected and the efficiency of financial market be enhanced by establishing a systemic and diversified financial dispute settlement mechanism?It is imperative to set up a three-dimensional consumer financial dispute settlement mechanism that allows both litigation and non-litigation.Although consumers and financial institutions as the main dispute bodies have different positions in their individual cases,they share a strong need for consumer financial dispute settlement and expectations for highly efficient and diversified non-litigation dispute settlement measures.
