中国未成年人羁押必要性审查制度构建

Investigation System of Chinese Juveniles Detainment Necessity

涉及未成年人刑事案件执法检查、民行检察统一集中办理给未成年人羁押必要性审查带来了审查主体、启动方式、审查过程以及结果跟踪四个方面的改变。杭州上城区院先行先试,通过首例案件的办理发现在试点工作实践中尚存在同案成年犯罪嫌疑人、被告人的羁押必要性审查主体、审查周期、审查方式等方面的问题,在审查的判断标准上,共同犯罪、罪名以及可能判处的刑罚成为重点讨论的三项内容。未成年人羁押必要性审查要发挥其独立价值,需从未检工作实际出发,以全面保护未成年人合法权益为价值追求,根据未检现行受案范围确定办理羁押必要性审查案件的范围;确立定期审查与随时审查相结合的审查周期;建立量化与非量化相结合的审查方式;依托社会支持体系,探索调查与审查分离机制,以此构建起未成年人羁押必要性审查制度。

Cases concerning juveniles,such as criminal cases and civil service procuratorial work,have brought great changes to the issue of the necessity for juveniles’detainment investigation in the following aspects:review subject,start-up mode,review process and result tracking.As a pilot district,Shangcheng,through its successful work,has found that there still exist some problems,such as adult criminal suspect,investigation subject of defendant detainment necessity,investigation time and method.In terms of investigation standards,joint crime,crime and possible penalty are three major issues to be discussed.This paper holds that the necessity of juveniles detainment investigation should take into the consideration of several factors:protection of legal rights of juveniles,the actual facts,the actual cases involved,in order to create a proper investigation system of juveniles detainment.
