土地转出农户的权益保护研究:满意度及策略应对

Research on Protection the Rights and Interests of Land-Transfer Peasant: Satisfaction Degree and Protection Strategy

土地高速流转带来的农户权益受损是不争事实,那么科学刻画农户权益受损态势并提出保护策略极为重要。对此,本文采用法理学和农业政策学相结合的研究范式,构建了"权益内涵-测度体系-受损刻画-应对策略"的分析框架,并利用全国1030份调研数据进行IPA分析。研究发现,农户的权益诉求从经济收益向权利主张拓展,70%的权益存在受损,50%受损严重,其中"地租价格的合理性、纠纷救济、非法用地拒绝权以及土地损坏恢复权"属于重点关注事项;基于此,提出了三个联动性的权益保护策略。论文贡献在于,引入法理学的逻辑,做到农户土地权益界定有理有法;科学制定评价指标体系,避免权益泛化或过载;IPA分析法有效区分了权益保护层次,联动性的保护策略避免了政策碎片化带来的高昂执行成本。

It is a well-established fact that the peasants’land rights and interests are damaged by the high-speed land transfer,so it is very important to scientifically peruse the situation and put forward protection strategy,which could even handedly guarantee peasants’land rights.Forgoing in view,this paper applies the research paradigm by combining jurisprudence and agricultural policy to construct an analytical framework of'right intension-measure system-damage characterization-coping strategy',then applies IPA analysis with 1030 survey data to check the model.Research has found that peasants’rights and interests expand from economic benefits to rights claim,70%of the rights are damaged and 50%are seriously harmed,such as the rationality of the land rent price,the relief of disputes and the right of refusing illegal land use and restoring damaged land which should be kept in check.Based on this,the study puts forward three strategies with linkage effect for the protection of farm’s rights and interests.The paper has three contributions.First,we make sure that the content of peasant’s land interests and rights combine the jurisprudence and agricultural policy.Secondly,we establish an index system to measure whether peasants’rights and interests are impaired.And finally,we use the IPA method to distinguish the level of protection of rights and interests,and propose relevant protection strategies,aptly aiding to the research question.
