环境监管执法发展思路与对策研究

Study on Development Ideas and Countermeasures of Environmental Supervision and Law Enforcement

近年来,环境监管执法事业取得显著发展成效,有力支撑了总量减排、质量改善等环境保护工作的开展。本文在分析我国环境监管执法发展形势和面临的困境的基础上,提出未来环境监管执法发展的建议。研究表明,现阶段我国环境监管执法仍面临诸多困境,环境违法现象居高不下,政府干预现象较为普遍,监管缺位问题相对突出,执法能力仍有待提高。未来一段时期,破解困境需要坚持以问题为导向,落实政府责任,健全执法机制与制度,提高执法能力,引导企业守法,加强公众参与,提高环境监管执法效率和效能。

In recent years,environmental supervision and law enforcement business has made remarkable achievements,which strongly supporting the work on the total emission reduction and law environmental quality improvement etc. Based on the analysis of national environmental supervision and law enforcement situations and difficulties,this paper puts forward to some suggestions for the development of environmental supervision and law enforcement in the future. The study shows that national environmental supervision and Law enforcement still faces many difficulties at present,environmental law violations remains high,the phenomenon of government intervention is common,the supervision absence issue is relatively prominent,and environmental enforcement capacity remains to be improved.In the coming period,difficulties to solve needs to adhere to problem- oriented,implement the governmental responsibility,improve environmental enforcement mechanisms and institutions,heighten environmental enforcement capacity,guide enterprises to follow the law,and strengthen public participation,in order to enhance the efficiency and effectiveness of environmental supervision and Law enforcement.
