建立国家层面的法律性别平等评估机制的有关问题探讨

Establishment of National Level Law Related to Gender Equity Evaluation Mechanism

2012年以来,由中华全国妇女联合会推动的地方法规的性别平等评估在评估主体、评估范围和评估程序以及评估依据等方面进行了探索。建立国家层面的法律性别平等评估机制应该总结地方成果,借鉴国际经验,明确具有中国特色的法律性别平等评估的理念和目标,建立专业、中立、客观的第三方专业评估主体,运用社会性别分析方法,设计具有可操作性的评估指南,最关键的是政府要把性别平等评估作为落实社会性别主流化的主要工具和策略落实到国家立法的具体过程中,成为立法评估的重要组成部分。建立国家层面的法律性别平等评估机制是中国性别平等的制度化落实;是中国落实性别平等的制度创新,也是科学立法、民主立法的实践与推动。

Since 2012 there are researches in local laws and regulations of gender equality,driven by the all-china women's federation,the scope of evaluation subject,evaluation and appraisal procedure and evaluation basis,etc. Establishing national level of gender equality should place achievements assessment mechanism,draw lessons from international experience,clarify law with Chinese characteristics and the concept of gender equality evaluation target,establish a professional,neutral and objective third-party assessment,and apply a gender analysis method. To design operable evaluation guidelines,the key is that the government put the gender equity evaluation as the main tool to carry out the social gender mainstreaming and specific process of strategy implementation to the national legislation as an important part of the assessment. Establishing a national level law gender equality evaluation mechanism is China's implementation of the institutionalization of gender equality,gender equality system innovation,and also a scientific legislation,legislative practice and promotion of democracy.
