性贿赂入罪的问题研究

中共十八大以来,中共中央重拳反腐,高级领导干部频繁落马。这充分表明中共中央从严治党,建设廉洁政治的决心。作为贿赂的一种新的形式——性贿赂频繁地成为官员落马案件的焦点,表明其具有极其严重的社会危害性,既侵蚀了国家工作人员的职务廉洁性,又败坏了社会风气。能否利用刑罚的手段对性贿赂予以制裁,在理论界仍是一个颇具争议的话题。通过对性贿赂的解读,阐释其基本内涵与特征,并认清当前性贿赂存在的现状,分析性贿赂入罪的可能性,选择一条合适的路径为性贿赂入罪提供科学合理的法律依据,以期为将来的相关立法提供参考。

Since the 18 th National Congress of the CPC,the CPC Central Committee has been tough with corruption and senior officials fall frequently,which shows the determination of the CPC Central Committee strictly administering the Party and constructing the clean politics.As a form of bribery crime,sexual bribery,which does a great harm to society,has become the main focus of officials' corruption.It not only erodes the integrity of government officials,but corrupts the social values and morality as well.The controversial issue remains whether the sexual bribery should be punished by law.The paper expounds the basic connotation and characteristics of sexual bribery,analyzes the feasibility of the conviction of sexual bribery,provides a reasonable and scientific legal ground for it,and offers a reference for the future relative legislation.
