摘要
在征收集体土地计算补偿款时,应将土地集体所有视为'一束权利',包含了集体的土地所有权、成员的土地承包经营权、宅基地使用权等多支权利。随着农民土地财产权利市场化资源配置的属性日趋明显,土地财产权能逐渐从'所有'转向'利用',土地集体所有所含的各支权利在征收补偿程序中可以使用不同的公平市场价值补偿方法计算。对于不能自由交易的权利,采用收益资本法;对于可以自由交易的权利,即土地承包经营权、建设用地使用权以及宅基地使用权和住房所有权,采用可比销售法。集体土地征收的补偿应从专注于集体的权利转向更多专注于成员的权利。
In the compensation procedure of expropriating collectively-owned land,land collective-owned should be regarded as'a bundle of rights',including the collective ownership of land,members’land contracted management rights,rural homestead-land-use right and the right of construction land use.With the increasingly obvious attribute of market-oriented resource allocation of farmers’land property rights,land property rights can gradually shift from'ownership'to'utilization'.In the compensation procedure,different fair market value compensation methods can be used to calculate the various rights of land collective-owned.For the rights that cannot be freely traded,that is,collectively-owned farmland,the investment income method is adopted.For the rights that can be freely traded,that is,land contracted management rights,the right of construction land use,rural homestead-land-use right and housing ownership,the comparable sales method shall be adopted.Compensation for collective land expropriation should be shifted from focusing on collective rights to more on the rights of members.
